This SMS Privacy Policy describes how AvataCore, LLC uses text message (SMS) communications, what types of messages you may receive, how to opt out, and your rights regarding SMS communications. AvataCore, LLC is a Delaware limited liability company and a technology and care coordination platform. References to "AvataCore," "we," "our," or "us" in this SMS Privacy Policy refer to AvataCore, LLC as the operator of the SMS messaging service.
2. Consent to Receive SMS Messages
By providing your mobile phone number to AvataCore and checking the consent box during enrollment, account registration, or checkout — or by otherwise affirmatively opting in to our SMS program — you consent to receive recurring automated text messages from or on behalf of AvataCore at the mobile number you provide.
Your consent covers the receipt of the types of messages described in Section 3 below. Consent is obtained prior to sending any marketing or promotional messages. Transactional and service messages (such as order updates and account alerts directly related to your care) may be sent as necessary to fulfill your service agreement with AvataCore.
How Consent Is Recorded
When you opt in to SMS communications, we record your consent including the date, time, and method by which consent was provided. This record is retained in accordance with our data retention practices and applicable law. You may request information about your consent record by contacting us at [email protected].
Your mobile number will not be shared with third parties for their own marketing purposes. We may use third-party messaging service providers to deliver SMS messages on our behalf; those providers are bound by appropriate data processing agreements.
3. Types of Messages You May Receive
Depending on your consent preferences and your activity on the AvataCore platform, you may receive the following categories of SMS messages:
Order and Shipping Updates
Notifications about the status of your prescription and medication order, including confirmation that your intake has been received, that a provider has reviewed your file, that a prescription has been approved, that your order has been sent to the pharmacy, that your medication has shipped, and estimated delivery information.
Account Alerts
Security-related notifications such as login verification codes, account activity alerts, password reset confirmations, and billing alerts including subscription renewal reminders and payment processing notifications.
Care Reminders
Reminders related to your treatment program, such as medication administration reminders, follow-up check-in prompts, or requests to complete outstanding intake information.
Promotional Messages
Information about AvataCore programs, services, special offers, or health and wellness content. Promotional messages are sent only to users who have specifically consented to receive marketing communications. You may opt out of promotional messages at any time without affecting your receipt of transactional or account messages.
4. SMS Is Not Required for Purchase
No Purchase Condition
Consent to receive SMS text messages from AvataCore is not a condition of purchasing any product or service. You may enroll in and use AvataCore services without consenting to receive marketing or promotional SMS messages.
While certain transactional SMS messages (such as prescription status updates and shipping notifications) may be sent as part of your standard service experience, you may request alternative delivery methods for notifications by contacting us at [email protected]. All account and order communications are also accessible through the AvataCore patient portal.
5. Message Frequency and Rates
Message Frequency
Message frequency varies based on your activity, subscription status, and communication preferences. You may receive multiple messages in a given period around key events in your care journey (such as prescription approval and shipping), and fewer messages during periods of inactivity. We do not commit to a fixed number of messages per week or per month.
Typical message volume for active subscribers ranges from a few messages per month to several messages per week during active order and treatment periods.
Message and Data Rates
Message and data rates may apply.
Standard message and data rates charged by your wireless carrier may apply to SMS messages you receive from AvataCore. AvataCore does not charge a separate fee for SMS messages. You are responsible for any charges your wireless carrier imposes in connection with sending or receiving text messages. Contact your wireless carrier for information about your messaging plan and any applicable fees.
6. How to Opt Out
You may opt out of receiving SMS messages from AvataCore at any time using any of the following methods:
Text STOP
Reply STOP to any SMS message you receive from AvataCore. You will receive a confirmation message acknowledging your opt-out. After opting out via STOP, you will no longer receive SMS messages from AvataCore except as required by applicable law.
Email Request
Email [email protected] with the subject line "SMS Opt-Out" and include your full name and the mobile number you wish to remove from our SMS list. We will process your request within 2 business days.
Patient Portal Settings
Log into your AvataCore patient portal and navigate to Account Settings to manage your communication preferences, including SMS opt-out options.
Opting out of SMS messages does not cancel your AvataCore subscription or affect your access to clinical services. If you opt out of SMS communications, we will communicate with you via email at the address associated with your account.
7. How to Get Help
If you have questions about AvataCore SMS communications or need assistance, you can get help in the following ways:
Text HELP
Reply HELP to any SMS message from AvataCore. You will receive an automated response with contact information and basic instructions for managing your SMS preferences.
Email Support
Email [email protected] with any questions about SMS communications, opt-out requests, or concerns about messages you have received. We aim to respond within 1–2 business days.
8. Wireless Carrier Liability
Wireless carriers are not liablefor delayed or undelivered SMS messages. Message delivery is subject to effective transmission by your wireless carrier, and delivery is not guaranteed. Factors outside AvataCore's control — including network congestion, carrier filtering, your wireless plan, your device settings, and geographic coverage — may affect whether and when you receive SMS messages.
If you are not receiving expected SMS messages from AvataCore, please check the following before contacting us:
- Confirm the mobile number associated with your AvataCore account is correct.
- Check that your device is not in Do Not Disturb mode or blocking messages from unknown senders.
- Verify you have not previously opted out by texting STOP — if so, text START to re-enable messages.
- Contact your wireless carrier to confirm there are no issues with your messaging service.
Time-sensitive information related to your medication orders and account is also available through the AvataCore patient portal. Do not rely solely on SMS messages for critical health or order information.
9. Privacy and Your Information
Your mobile phone number and SMS communication preferences are treated as personal information subject to our main Privacy Policy. We collect your mobile number for the purpose of sending SMS communications as described in this policy.
- No Sale of Mobile Numbers: We do not sell, rent, or trade your mobile phone number to third parties for their own marketing purposes.
- Third-Party SMS Providers: We may use third-party SMS platform providers to send text messages on our behalf. These providers access your phone number only to the extent necessary to deliver messages and are contractually prohibited from using your information for any other purpose.
- Retention: Your mobile number and SMS consent records are retained in accordance with our data retention practices and applicable law. You may request deletion of your mobile number from our SMS system by opting out and submitting a deletion request to [email protected].
- TCPA Compliance:AvataCore's SMS communications are intended to comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations governing commercial text messaging.
