Important: Please read these Terms of Service carefully before enrolling in AvataCore services. By accessing our website or subscribing to our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Patient," "User," or "you") and AvataCore, LLC ("AvataCore," "we," "our," or "us"), a Florida limited liability company, governing your access to and use of our website located at avatacore.com, our mobile and web applications, and all related telehealth and care coordination services (collectively, the "Services").

By clicking "I Agree," completing registration, or using any part of the Services, you represent and warrant that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Platform Description & Disclaimer

IMPORTANT — PLEASE READ CAREFULLY:

  • AvataCore is NOT a healthcare provider, medical practice, pharmacy, or insurance company.
  • AvataCore does not employ physicians, nurse practitioners, or any other licensed clinical professionals to provide medical care.
  • AvataCore does not diagnose conditions, prescribe medications, or provide medical advice.
  • AvataCore does not dispense, manufacture, or distribute prescription medications.
  • AvataCore is not a substitute for in-person medical care.

AvataCore is a technology and care coordination platform that connects patients with independent, licensed telehealth healthcare providers and licensed compounding pharmacies. All clinical services are provided exclusively by independent licensed healthcare providers who are not employees or agents of AvataCore. Clinical operations are facilitated through our clinical fulfillment partner network.

All medical decisions — including assessment of patient eligibility, diagnosis, treatment planning, and issuance of prescriptions — are made solely by the independent licensed healthcare providers. AvataCore makes no guarantee that a subscription will result in a prescription being issued. Providers exercise independent clinical judgment and may decline to prescribe if they determine a patient is not an appropriate candidate.

Pharmacy services are provided by independent, state-licensed compounding pharmacies. AvataCore does not own, operate, or control any pharmacy.

3. Eligibility Requirements

To use our Services, you must meet ALL of the following requirements:

  • Age: You must be at least 18 years of age. AvataCore does not knowingly provide services to individuals under 18. If you are under 18, do not use our Services.
  • Residency & State Availability: You must be a resident of the United States. Our Services are available only to US residents in states where our provider network holds an active license to practice. Availability varies by state and is subject to change without notice as licensure status changes. By enrolling, you confirm you reside in a state where our Services are currently available. If our Services become unavailable in your state after enrollment, we will notify you and provide a prorated refund for any prepaid period during which Services are suspended. AvataCore makes no representation that Services will be available in any particular state indefinitely. To confirm current availability in your state, contact us at support@avatacore.com before subscribing.
  • Legal Capacity: You must be legally capable of entering into a binding contract under applicable law.
  • Accurate Information: You must provide truthful and complete health information. Providing false or misleading health information is grounds for immediate account termination and may pose serious health risks.
  • One Account: You may maintain only one active account. Accounts are personal and non-transferable.

4. Telehealth Disclaimer

Telehealth services have inherent limitations compared to in-person medical care. By using our Services, you acknowledge and agree that:

  • Telehealth is not appropriate for all medical conditions, emergencies, or circumstances
  • Your provider cannot physically examine you and relies on information you voluntarily provide
  • The quality of care may be affected by the completeness and accuracy of information you provide
  • Technical failures (internet outages, platform errors) may delay or interrupt your care
  • In the event of a medical emergency, call 911 or go to the nearest emergency room immediately — do not use telehealth services for emergencies
  • GLP-1 medications carry risks and may not be appropriate for all individuals
  • Individual results vary; weight loss outcomes are not guaranteed
  • Telehealth does not replace a relationship with a primary care provider
  • You should inform your primary care provider of all treatments received through AvataCore

5. Subscription Plans & Pricing

AvataCore offers the following subscription structure. All prices are in US dollars. Each plan includes a telehealth consultation, provider access, prescription (if medically appropriate), compounded GLP-1 medication, and free shipping:

Pricing is the same for every visit (no intro-then-rebill structure). Tirzepatide (GLP-1 + GIP) is priced differently than semaglutide; see product pages for current pricing. AvataCore does not sell, dispense, or ship branded medications (Ozempic®, Wegovy®, Zepbound®, Mounjaro®). If your provider writes a prescription for a branded medication, you are responsible for filling it at the pharmacy of your choosing and for all associated costs.

All prices are subject to change. We will provide at least 30 days advance written notice via email before implementing any price increases for existing subscribers. Price changes take effect at your next renewal period following the notice period.

6. Auto-Renewal & Billing

Your subscription automatically renews at the end of each billing period.By subscribing, you authorize our clinical fulfillment partner (merchant of record) to charge your payment method on file on a recurring basis until you cancel. You will be charged the then-current subscription rate. Your credit-card or bank statement will reflect a descriptor associated with our clinical fulfillment partner (typically appearing as "OPNLP Health").

  • Monthly plans: Your introductory plan starts at $149 (semaglutide injections) or $199 (tirzepatide injections) for the first month; ongoing months bill at the standard plan rate (see product pages for current pricing). Subscription auto-renews monthly until cancelled. Cancel anytime
  • 12-Week plans: Renew automatically every 84 days from enrollment date
  • 6-Month plans: Renew automatically every 168 days; you will receive a reminder email 14 days before renewal

Your first charge occurs upon enrollment confirmation. Subsequent charges occur at the beginning of each new billing period. Payments are processed by our clinical fulfillment partner, the merchant of record for all patient transactions. our clinical partner uses PCI-DSS compliant third-party payment processors and does not store your full payment card information. AvataCore does not process, store, or receive patient payment card information at any time.

If a payment fails, our clinical fulfillment partner (as merchant of record) will attempt to charge your payment method up to three times over 7 days. If payment remains unsuccessful, your account may be suspended until the outstanding balance is resolved.

7. Cancellation Policy

You may cancel your subscription at any time. To ensure a smooth process, we require your cancellation request to be received at least 72 hours prior to your next billing date. If this notice window is missed, your subscription will be charged on the upcoming billing date and the cancellation will take effect on the subsequent billing date. After cancellation, you will continue to receive the Subscription Services through the end of your paid billing cycle.

  • Monthly subscribers: Submit cancellation at least 72 hours before your next monthly billing date. Access and any scheduled medication shipments continue through the end of the current 30-day period.
  • Quarterly subscribers: Submit cancellation at least 72 hours before the next quarterly renewal. Access continues through the end of the current 90-day quarter.
  • Annual subscribers: Submit cancellation at least 72 hours before the next annual renewal. Access continues through the end of the current 365-day year.

How to cancel: Log into your patient portal and navigate to Account > Subscription Settings, or email us at support@avatacore.comwith the subject line "Cancel Subscription."

8. Refund Policy

You may request a refund of your current billing cycle only if, at the time of the request, your medication has not yet been ordered by the pharmacy. For new patients, medication is generally ordered upon completion of your intake (or at the end of your live video visit, if one is required). For returning patients, medication is typically ordered when a refill intake is submitted for that billing cycle. Refunds are only issued for the most recent billing cycle and are not issued for past billing cycles.

  • Provider Ineligibility: If an independent licensed provider determines you are not a candidate for GLP-1 therapy, your subscription will be canceled and our clinical fulfillment partner (merchant of record) will refund your first subscription payment within 5–7 business days.
  • Bundle Pricing: If you purchased a bundled (multi-month) plan, refunds are calculated on a prorated basis, using the number of months of medication shipments already received and the regular (non-bundle) monthly price.
  • Damaged or Incorrect Items: If your medication is confirmed damaged or incorrect, the pharmacy will typically replace the medication; refunds for damaged or incorrect items are considered on a case-by-case basis upon evidence.
  • General Non-Refundability: Federal law generally prohibits the return of prescription medications to pharmacies once ordered. Subscription fees for a billing cycle are non-refundable once the medication for that cycle has been ordered.
  • Discretionary Exceptions: Refund exceptions may be granted at AvataCore's sole discretion for documented extraordinary circumstances. Contact us at support@avatacore.com.

Chargebacks or disputes filed with your bank without first contacting AvataCore may result in account suspension. We encourage you to contact us directly to resolve any billing concerns. See our Cancellation & Refund Policy for the full policy.

9. Medication Acknowledgment & Risks

By using our Services, you acknowledge and accept the following regarding GLP-1 medications (including semaglutide and tirzepatide):

  • Compounded Medications: Medications provided through AvataCore are compounded by licensed compounding pharmacies. Compounded medications are not individually FDA-approved, though the active pharmaceutical ingredients used are FDA-recognized compounds. Compounded drugs differ from commercially available brand-name products.
  • Known Side Effects: GLP-1 medications may cause nausea, vomiting, diarrhea, constipation, decreased appetite, fatigue, injection site reactions, headache, dizziness, and other side effects.
  • Serious Risks: In rare cases, GLP-1 medications may cause pancreatitis, gallbladder disease, kidney problems, elevated heart rate, or thyroid tumors (based on animal studies; human relevance is unknown). GLP-1 medications are contraindicated in patients with a personal or family history of medullary thyroid carcinoma (MTC) or Multiple Endocrine Neoplasia syndrome type 2 (MEN 2).
  • No Outcome Guarantees: Weight loss outcomes are not guaranteed. Individual results vary based on adherence, lifestyle factors, metabolism, and other individual physiological factors. AvataCore makes no representation that you will achieve any specific result.
  • Medication Handling: You agree to store, handle, and dispose of all medications strictly in accordance with the instructions provided by the dispensing pharmacy and your prescribing provider. You agree not to share your prescription medication with any other person.
  • Adverse Event Reporting: You agree to promptly report any adverse effects, unexpected reactions, or health concerns to your provider through the patient portal.

10. Patient Responsibilities

As a condition of using the Services, you agree to:

  • Provide accurate, complete, and current health information at all times — including all current medications, supplements, medical conditions, allergies, and relevant medical history
  • Immediately notify your provider of any changes in your health status, new medications, or significant side effects
  • Follow your prescribed treatment protocol as directed by your independent healthcare provider
  • Maintain a relationship with a primary care provider for comprehensive healthcare needs outside the scope of our Services
  • Not use our Services as a substitute for emergency medical care — call 911 in any emergency
  • Keep your account credentials confidential and notify us immediately of any unauthorized account access
  • Comply with all applicable laws regarding prescription medications
  • Ensure that the shipping address provided is a valid US address where you legally reside
  • Not sell, transfer, or share prescription medications

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVATACORE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF AVATACORE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

AvataCore's total aggregate liability for any and all claims arising from or relating to these Terms or the Services shall not exceed the total amounts paid by you for AvataCore's services (including amounts collected by our clinical fulfillment partner as merchant of record on AvataCore's behalf) in the twelve (12) months immediately preceding the claim giving rise to liability.

AvataCore is not liable for the acts or omissions of independent licensed healthcare providers or independent pharmacies. Clinical decisions are made solely by licensed providers and AvataCore has no control over, and assumes no liability for, clinical judgments made by those providers.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you. In such jurisdictions, liability is limited to the fullest extent permitted by law.

12. Intellectual Property

All content on the AvataCore website and platform — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — is the property of AvataCore, LLC or its content suppliers and is protected by United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our platform without our express prior written consent.

The AvataCore name, logo, and related marks are trademarks of AvataCore, LLC. Nothing in these Terms grants you any right to use our trademarks.

13. Privacy & HIPAA

Your privacy is important to us. Our collection, use, and disclosure of your personal information and protected health information (PHI) is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We are committed to maintaining the privacy and security of your health information in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the HITECH Act, and applicable state privacy laws. All vendors who handle your PHI are required to execute HIPAA Business Associate Agreements (BAAs).

By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

14. Communications Consent (SMS, Email, Calls)

By providing your contact information (phone number, email address) to AvataCore, you consent to receive transactional and promotional messages via SMS/text message, email, and phone call from AvataCore and our clinical fulfillment partner (our clinical partner and the merchant of record). Transactional messages include prescription updates, shipping notifications, appointment reminders, and care-related communications. Promotional messages may include offers, wellness tips, and program updates.

  • Message Frequency: Message frequency varies based on your activity and program enrollment.
  • Rates: Message and data rates may apply. Check with your wireless carrier for details.
  • Opt-Out (SMS): Reply STOP to any text message to opt out of marketing SMS. Reply HELP for assistance. Opting out of marketing SMS does not opt you out of transactional messages related to your prescriptions, shipping, or care.
  • Opt-Out (Email): Click the unsubscribe link in the footer of any marketing email. Transactional emails related to your care and account cannot be opted out of while your account is active.
  • Phone Calls: Calls may be recorded for quality assurance and compliance purposes.

15. Dispute Resolution & Arbitration

15.1 Governing Law

These Terms and any disputes arising from them are governed by the laws of the State of Florida, without regard to its conflict of law provisions. To the extent state telehealth or medical practice laws apply, the laws of the state in which the patient receives services may also apply.

15.2 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at support@avatacore.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving written notice.

15.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted on an individual basis; class action arbitrations are not permitted.

15.4 Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property rights, unauthorized access, or imminent harm. Nothing in this section limits your right to file a complaint with state regulatory agencies or the U.S. Department of Health and Human Services.

15.5 Class Action Waiver

YOU AND AVATACORE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. State-by-State Availability Disclaimer

Telehealth prescriptions for GLP-1 medications are subject to state-specific laws and regulations. AvataCore is currently offering services in all 50 states plus Washington D.C. Some services may not be available in all 50 states or Washington D.C. See our state availability page for the current list of states where services are live. Subject to change.

AvataCore does not currently serve every state for every medication, and availability may change as provider licensure, pharmacy distribution agreements, and applicable regulations evolve.

  • Verify Before Subscribing: You are responsible for confirming that AvataCore Services are available in your state of residence before completing enrollment. Current state availability is displayed during the enrollment flow and can be verified by contacting support@avatacore.com.
  • Service Suspension in Your State: If telehealth GLP-1 services become unavailable in your state after you have enrolled — due to changes in state law, loss of provider licensure, or regulatory action — AvataCore will notify you by email and provide a prorated refund for any prepaid subscription period during which Services are suspended or unavailable.
  • State-Specific Restrictions: Certain states impose additional requirements on telehealth prescribing, such as mandatory prior in-person visits, specific informed consent procedures, or formulary restrictions. Where such requirements apply, your provider will inform you of any additional steps needed to receive care in your state. AvataCore makes no representation that all medications or dosing options are available in every state.
  • No Guarantee of Continued Availability: AvataCore makes no guarantee that Services will remain available in any particular state indefinitely. Expansion to additional states and any reduction in available states will be communicated through the AvataCore website and by email to affected subscribers.

State availability information is provided for general guidance only and is subject to change. Nothing in this section constitutes legal advice. If you have questions about whether telehealth GLP-1 services are lawfully available to you in your state, consult a qualified healthcare attorney or your state medical or pharmacy board.

17. Pharmacy Partners

Prescriptions issued through the AvataCore platform are filled by independent, state-licensed compounding pharmacies. AvataCore does not own, operate, or control any pharmacy. The specific pharmacy assigned to your prescription is determined by your provider, medication, and state of residence, and may change over time. Current pharmacy partners include:

While our pharmacy network collectively has licensure to ship to all 50 states plus Washington, D.C., active AvataCore service availability also depends on provider licensure in each state — see our state availability page for the current list of states where services are live. Subject to change.

This list is current as of the "Last Updated" date above and may change without notice as pharmacy partnerships evolve. For questions about which pharmacy is filling your prescription, contact the AvataCore support team or your assigned provider.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes (including changes to pricing, arbitration provisions, or significant limitations on your rights) will be communicated by email to your registered address at least 14 days before taking effect.

Non-material changes (such as clarifications, formatting updates, or corrections of typographical errors) may be posted without prior notice and take effect upon posting.

Your continued use of the Services after the effective date of any change constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must cancel your subscription and stop using the Services before the effective date.

We encourage you to review these Terms periodically. The "Last Updated" date at the top of this page reflects the date of the most recent revision.
